Personal Data Protection Notice
At Jayasuriya Kah & Co. (“the Firm”), we care about your Personal Data protection. This Personal Data Protection Notice (“Notice”) sets out how the Firm collects, uses and protects your Personal Data (hereinafter defined) which you have provided to the Firm. By providing the Firm your Personal Data, communicating with the Firm, engaging the Firm to provide the services you have requested (“Services”) and/or by accessing the Firm’s website [www.jaykah.com.my] (“Website”), you hereby consent to the processing of your Personal Data by the Firm for the purposes and in the manner as provided below:

COLLECTION AND SOURCE OF PERSONAL DATA
1.1
For purposes of this Notice, “Personal Data” means any personally identifiable data that you provide or have provided to the Firm including data such as your name, contact details, address, email address, NRIC number or passport number, personal preferences, particulars of your spouse or family members and bank account information, and any information which may identify you, your spouse or family members.

In addition to the Personal Data that you provide to the Firm directly (such as when the Firm is engaged to provide Services or during any other communication with the Firm), the Firm may also collect your Personal Data from various other sources, including without limitation, from online search facilities, public registries / databases, information obtained from third parties through lawful sources (including Federal, State or local government departments / statutory or regulatory authorities), information gathered from events organized by the Firm, and/or from the cookies used on the Website.
1.3
In respect of Personal Data of third parties (such as your spouse, family members or colleagues) that you may provide to the Firm, you warrant that you have obtained such third parties’ consent to permit the Firm to process their Personal Data as set forth within this Notice and that you will extend a copy of this Notice to such third parties.

Personal data of individuals under 18 years old will be processed only with the consent of their parent or legal guardian.

PURPOSE OF COLLECTION AND PROCESSING OF PERSONAL DATA
2.1
You hereby agree and consent to the Firm collecting, using and processing your Personal Data for the Firm’s business purposes including in the manner and for the purposes as described below:
- for the purposes of the Services;
- for the preparation of any document or instrument which may be required for the Services and such other ancillary work in connection with the Services, including but not limited to, preparing the necessary agreements, instruments or documents to which you are a party (e.g., loan agreement, sale and purchase agreement, tenancy agreement) and preparing cause papers and affidavits;
- to provide such necessary information to any regulatory or governmental authorities as may be required under law or any other governmental requirements;
- for the Firm’s internal administrative purposes including for billing or invoicing, for record keeping, and for purposes of conducting due diligence checks and conflict of interest checks;
- for the Firm to communicate with you including as set out in Paragraph 2.3;
- for the Firm to comply with its obligations under law or any regulations imposed by regulatory or governmental authorities; and
- for the purposes of recruitment and other legitimate business purposes.
2.2
It is voluntary for you to supply your Personal Data to the Firm. However, if you do not wish to provide your Personal Data, the Firm may not be able to:
- provide you the Services you require; or
- communicate effectively with you.
2.3
The Firm may also use and process your Personal Data for other purposes such as to send you communication such as festive greeting cards, newsletters, articles, write-ups and other updates, distribute information of or invitations to events, conferences, talks and seminars which may be of interest to you; if any, by way of email or mail.

If you do not agree or consent to the Firm processing your Personal Data for the purposes set out in this Paragraph 2, please notify the Firm in writing at the contact details set out in Paragraph 7.1 below.

DISCLOSURE OF PERSONAL DATA
3.1
In order to provide the Services, it may be necessary for the Firm to engage third party companies, service providers or individuals to perform certain services on the Firm’s behalf. In such event, you hereby agree and consent that the Firm may disclose and transfer your Personal Data to the third parties, within or outside Malaysia, including without limitation, as follows:
- banks and financial institutions;
- insurance providers;
- storage facility providers;
- courier service providers;
- information technology (IT) service providers;
- external advisors and other professional advisors, such as company secretaries, lawyers or auditors; and
- such other party as the Firm deems necessary for the purposes mentioned in Paragraph 2 above.
3.2
The Firm may also disclose and transfer your Personal Data to any statutory bodies, regulatory bodies and/or governmental authorities where legally required to do so.

4.1
The Firm may use cookies on its Website. If you do not wish for your Personal Data to be collected via cookies, please configure your internet browser to delete or deactivate cookies.

The Firm’s Website may contain links to other sites and pages. The Firm shall not be responsible for any Personal Data or information that you may provide to other entities via these links.

SECURITY MEASURE
5.1
We endeavour, where practicable, to implement the appropriate administrative and security measures which safeguard against the unauthorised or unlawful processing of your Personal Data and the accidental loss or destruction of, or damage to, such Personal Data.

PERSONAL DATA RETENTION PERIOD
6.1
We will retain your Personal Data for the duration necessary to fulfill its intended purpose. Upon completion of the purpose, we may continue to retain your Personal Data depending on the circumstances. If you are no longer our customer, we may permanently delete your Personal Data.

Please note that under circumstances permitted by law, the Firm has the right to refuse your request to access your Personal Data or the right to refuse to make any corrections to your Personal Data. The Firm has the right to charge a fee for access to your Personal Data in accordance with applicable law.
7.3
In the event of any changes to your Personal Data, you are obliged to promptly notify the Firm via the contact details set out in Paragraph 7.1 above.
7.4
In the event that you withdraw your consent or restrict the purposes and methods in which your Personal Data is processed by the Firm, we may not be able to continue to provide you the Services you require.

GENERAL
8.1
The Firm reserves the right to amend or modify this Notice from time to time.
8.2
This Notice is issued in both English and Bahasa Malaysia. In the event of any inconsistencies or discrepancies between this English version and the Bahasa Malaysia version, the English version shall prevail.

Please note that notwithstanding the withdrawal of your consent, we may still process your personal data under circumstances permitted by law.
